This is an interesting article on recycling from... RISMEDIA, October 28, 2009—(MCT)—That little extra bit of money in the form of a larger paycheck tied to the Obama stimulus plan could end up taking a bite out of your federal income tax refund or even leave you owing taxes, say observers.

The stimulus plan lowered federal income tax withholding rates, which results in more take-home pay but less money going toward taxes. The downside is some taxpayers may end up with not enough taxes being withheld to cover what they owe in 2009.

As a result, some taxpayers may need to increase their withholding amount by reducing the number of allowances claimed for the rest of year, which means making changes to a W-4 form available from an employer’s human resources department. Single taxpayers who are working at more than one job and married couples filing jointly in a situation where both spouses work are the most likely groups of taxpayers to be caught short. “They are probably going to find out they are either getting a lot less back or they might owe,” said Mark Steber, chief tax officer at Jackson Hewitt Tax Service, a tax preparation firm.

New Home Buyer Tax Credit and Extention of the 1st Time Homebuyer Tax Credit

RISMEDIA, November 6, 2009-After the Senate gave final approval last night without a dissenting vote, the House of Representatives voted overwhelmingly this afternoon to pass legislation containing an extension and expansion of the homebuyer tax credit, completing Congressional action and sending the tax credit to President Obama for his signature, possibly as early as tomorrow.

The $8,000 homebuyer tax credit for first-time buyers, due to expire in 25 days, will be extended through April 30 of next year and buyers will have an additional two months, until the end of June, to close. First-time buyers who are in the process of making a purchase will no longer need to worry about qualifying for the $8,000 credit if they close after the November 30 deadline. The new legislation increases the income limit for couples with income up to $225,000, a nearly $55,000 increase above the level in existing law.

For the first time, the new legislation makes buyers who already own a home eligible for a credit. A $6,500 maximum credit will be available to existing homeowners who have lived in their current residence for five of the prior eight years. The legislation limits eligibility for the existing homeowner credit to homes worth $800,000 or less.

  When to DISCLOSE a "Smelly" site? NORTH LAS VEGAS- Beazer Homes Sued over Pig Farm

  This is an interesting article in the Las Vegas Sun

  This is the same pig farm that has been a feature of "Dirty Jobs" TV show. R.C. Farms, Inc., is a pig farm that has been in North Las Vegas since 1963 and in recent years there has been a lot of talk and complaints....but.....His farm has been there since  1963.

  Usually, when you get within a mile of the farm or, if you are driving in the area for any length of time.....You know it! There has been so much controversy over this farm and yes, I would not want to live to close as the smell is just too much,,,but it still goes back to the fact that the farm has been there since 1963.

  Buyers of a North Las Vegas home are suing a home builder, charging the company failed to disclose the presence of an area pig farm that is generating odors the homeowners say are unbearable.

  They say in the suit that under Beazer's development agreement with the city of North Las Vegas, it was required to obtain signed releases from prospective homeowners acknowledging the existence of the R.C. Farms pig farm and that the housing development may be subjected to odors from the farm.

  But the Riccis say Beazer didn't provide the required information about the farm and after they moved in and noticed the odor, they asked the Beazer sales person who sold them the home about the issue.
The sales person denied any duty to disclose the presence of the farm, reasoning it was too far away from the home to necessitate disclosure, the lawsuit says.

  Disclose, Disclose, Disclose.... we are always told this, but, "Directions calculated by mapquest.com indicate the farm is a 1.7-mile drive from the home"...  so at what point will it be determined that a radius or distance of "X" amount of miles from a site that emits a "Smell", be it a pig farm, chicken farm or something else would make it necessary to disclose? 

  Being from the south I've been around a lot of different type of farms and usually when you are within a half a mile of some farms,,,,you know it. We almost bought a home in Florida that was over 2 miles from a chicken farm....didn't know it on the 1st visit or the 2nd...but geez one more trip by the place and we knew it...Took a bit of driving around to locate the "source", but it definitely changed our minds about the place.  Ok, maybe most buyers don't drive the area and go by 3 times,,,,Maybe you should!  Just like the suggestion I make to buyers to drive the neighborhood after dark on Fri/Sat nights.  It may not always be a guarantee of what an area is like, but sometimes it is.  And, contrary to what buyers may think,,,,,your real estate agent doesn't know everything about every neighborhood,,,at least that is my opinion.  We may become an "expert" on an area, but there are always things we may not know....(ok hope I don't get blasted by other agents for that)

  I know on a windy day (which happens all the time here) I have been in North Las Vegas near Alianta and I knew the smell in the air most likely was from the farm, could I prove it, not likely. So, if someone is buying in North Las Vegas anyplace East of Alianta, I now may need to say, "hey, do you know about the farm a few miles away,,no? well there is,,just so you know,, on a windy day you may notice a "smell",,,etc,,,, (or do I?) maybe I need to consider a written disclosure on it now.....Maybe, I could print out this blog and have them sign it as "disclosure"..LOL...
It will be interesting to hear the outcome.

It's a fair question. In normal market situations, a bank will repossess a home and usually process it through to a listing agent to put on the MLS within 30 days. In a relatively short period of time, virtually every marketable REO property finds itself listed for sale on the local MLS. Today, that's simply not the case; it's likely that between 450,000 and 500,000 properties repossessed over the past year are still not on the market. And with buyers hungry for housing bargains, and agents and brokers chomping at the bit ready to sell the properties, it begs for a reasonable answer.

  Lenders and servicers admit that it's taking longer to process REOs than it has in the past, and they offer a number of legitimate reasons:

  -Many of the properties have title issues that need to be resolved.
-Many of the properties are in states of utter disrepair.
-A number of states have strict redemption-rights periods, which prevents the lender from reselling the property.
-A few states have extended the length of eviction proceedings.
What else could be slowing things down?

  A popular theory is that many banks are holding the properties off the market in order to defer losses. There is some accounting logic to this theory, as in most cases, banks aren't required to adjust asset prices until the actual resale of the property. Another idea is that the industry is holding back the inventory to create leverage with the government in order to force the creation of a "toxic bank" or RTC-like entity that would buy the distressed assets at 50 to 60 cents on the dollar rather than the 30 to 35 cents available on the market today. This theory suggests that, seeing the threat of a massive inventory of distressed homes being released all at once, the government would "blink" rather than risk another housing market meltdown.

  Whatever the reason-process issues or conspiracies-we're going to continue to see record-breaking numbers of REOs for at least the next year, and we'll all be watching to see when these sought-after homes finally make their way to the market.

  To minimize potential fraud by imposters, representatives will not be permitted to accept mortgage payments or any other money from borrowers...this is except from recent article about Freddie doing loan mods door-to-door

  Las Vegas has become known for having lots of scammers showing up at the door and calling people to try and get their $ by whatever tactic they can and there are still people falling for the scams and giving people money up front before they even check the person or company out.

  I recently had a couple ask me if they could give me their mortgage payment to turn into the bank...NO!!!

  Unfortunately, I have also been meeting a lot of people who have been scammed out of thousands of dollars by loan modification companys as well.

  NEVER PAY a Mortgage payment to someone who comes to your door!! Spread the word!

  McLean, VA - Freddie Mac (NYSE:FRE) today announced it has hired Titanium Solutions, Inc. to meet with delinquent borrowers at their homes and help them supply missing information, documents and complete other actions needed to begin their three month trial payment periods for Home Affordable Modifications under President Obama's Making Home Affordable program.

This is just a basic starter list.  Your lender may require you to provide more or less documents, but these are what you need to be prepared to provide to so that your short sale will go more smoothly.

DOCS NEEDED For Short Sale

•1.       Authorization form to lender

•2.       Hardship letter

•3.       Mortgage Statement

•4.       Financial Worksheet  

•5.       2 months paystubs

•6.       2 months bank statements

•7.       2 years tax returns

If you don't have 5,6, or 7, you will need to provide a letter explaining a valid reason why you don't have them to present to the bank and it could hinder the short sale process.

    RISMEDIA, September 22, 2009-Production of new single-family homes slowed in August 2009 as the expiration date for an important buyer incentive drew nearer, according to figures recently released by the U.S. Commerce Department. While overall housing starts rose 1.5% to a seasonally adjusted annual rate of 598,000 units for the month, single-family starts declined 3% to a rate of 479,000 units, ending what had been a five-month run of improvements.

    "With the $8,000 first-time home buyer tax credit set to expire at the end of November, the window is now basically closed for being able to start a new home that can be completed in time for purchasers to take advantage of that," said Joe Robson, Chairman of the National Association of Home Builders (NAHB) and a home builder from Tulsa, Okla. "Builders are therefore pulling back on new construction at this time. Clearly Congress must act now to extend the tax credit if we are to keep the market moving toward a recovery."

    "The tax credit has been helping buoy demand for new homes since its passage in February, but builders are concerned about what happens after it is gone," said NAHB Chief Economist David Crowe. "On top of the credit's impending expiration, builders continue to grapple with a severe lack of credit for housing production loans and inappropriately low appraisals that are tied to the use of distressed properties as comps - both of which blunted the tax credit's positive effect. Together, these three challenges threaten to completely stifle the upward momentum we've seen in the first half of 2009."

    BREAKING LAS VEGAS NEWS: Homes inventory is dropping, Multiple offers on homes…

    Vegas is heating up again…it is that time of year both in the housing market and the temperatures (although you wouldn’t know it by looking out the window this morning looks like a storm is coming and the past few days have been cooler than normal).

    The amount of Single Family homes for sale on the MLS has dropped and the amount of homes in Pending or Contingent status (this means they have contracts on them) has increased to more than the amount of homes for sale. This may be in part due to Short Sales taking longer to actually close than a typical sale, although I have been seeing some short sales close in 60 days from list to close, but I don’t believe that is the norm.

    This information was obtained from our local MLS this am and covers the Las Vegas valley, North Las Vegas, Summerlin and Henderson area for resale single family homes, not new homes.

    Homes for sale in Las Vegas are comprising primarily of REO (Bank Owned) and Short Sales. Short Sales may soon be the leader in types of homes for sale in Las Vegas.

    Buyers need to understand that this is typically the “Hot” season for buyers in Las Vegas. Add to that the fact that prices are so low on homes, investors are back and the first time home buyers tax credit and you have a feeding frenzy of multiple offers above asking price on a majority of the homes.

    Cash buyers are back as well and in all price ranges. This may be due to the great prices and due to the fact that their money won’t get much of a return right now in CD’s and money markets.

    This is a time for buyers to have patience and perseverance when buying a home in Las Vegas. Work with one agent and be prepared to that you may have to put in many offers on a several homes before you get an accepted contract.

    You also should prepare yourself to wait and hear about your offer for approx 7 days now if you put in offers on bank owned. Why? There can be more than one reason for this, but the banks may want that time to receive as many offers as they can get and will usually pick the highest and best priced offer and they may have to submit all offers to a group of investors to approve the offer.

    Some buyers may prefer to put in offers on short sales and skip the bank owned homes, but buyers need to be aware that these too are getting multiple offers as well and short sales will take longer to close. Plan on about 3-4 months from offer accepted to move in.

    Agent Tips To Buying a REO - Foreclosure Home in Las Vegas by Dawn Barrier "Begin-Prequalify"

    Work with a REALTOR® like me that has your best interest in mind.

    You want to work with a REALTOR® that listens to your needs and desires and can help you achieve your goals while keeping in mind the limits of your pre-qualifed buying power (the amount you can afford).

    If you are in the market for a Las Vegas home and are not working with a Realtor, call me.
    Get PRE-APPROVED, Not (just pre-qualified)

    THIS STEP MUST BE DONE!! You can't Skip it!

    You want to get Pre-approved prior to viewing any homes on the market.
    This means you get with a lender of your choice, (call me if you don't have one and would like some more info), and you give them all your work history, they actually get your credit report and score, you will provide them with w-2's, you go over your current expenses, etc and they will let you know the financing programs available to you so you know up front how much home you can afford to buy and what your approx. monthly payments will be.

    The lender will then give you a PRE-APPROVAL letter. You will need to make copys of this to provide to your REALTOR®. A copy of this letter MUST be sent with every offer you make. All Bank owned REO homes for sale on the MLS will REQUIRE this letter to be submitted with your offer and they will call your lender to verify that the letter is stating the facts.

    ALSO, be prepared that you may have to go thru another Pre-approval process with the Banks own Preferred lender Prior to putting in an offer, or w/in the same day of putting the offer in. This does Not mean you have to use the bank preferred lender, but it does give the bank more assurance that you are qualified (they may want to see those credit scores and w-2's, not just take the word of another lender) and they may even offer you a better deal on financing. They want to make sure that if your lender can't fund your loan, they will be able to step in and get it done so you can close the deal.

    This is just the start of my tips to buying an REO home, but this is the most important information to get you started. There will be more to follow and if you scroll thru my blogs you may find past tips as well.

    Wow, times are tough we all know, even the biggest of the big builders will continue to struggle to survive.

    The deal may create the largest U.S. homebuilder.
    According to Pulte CEO Richard J. Dugas Jr. the combination will put both firms "in an excellent position to navigate through the current housing downturn" and "accelerate a return to profitability."..bizjournal

    The combined company will use the Pulte name and be based in Bloomfield Hills, Mich., but the firms said a "significant presence" will be maintained in Dallas....bizjournal
